Welcome to campersAPP. campersAPP is operated by Gere Enterprises LLC d/b/a campersAPP (“campersAPP,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) apply to your use of the campersAPP mobile application, campersAPP.com, the campersAPP Campground Dashboard, and related campersAPP services (collectively, the “Service”).
By accessing or using the Service, creating an account, accessing the Campground Dashboard, or participating in a feature that references these Terms, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
Participating campgrounds, RV parks, resorts, and other properties available through campersAPP are referred to in these Terms as “Campgrounds.”
Campground subscribers may also be subject to separate subscription, service, or commercial agreements with campersAPP. If a separate written agreement conflicts with these Terms regarding a Campground’s commercial use of the Service, the separate agreement will control.
1. About campersAPP
campersAPP provides technology that Campgrounds use to communicate with guests and offer information, activities, services, purchases, games, loyalty programs, forms, maps, promotions, and other digital campground experiences.
Features vary by Campground. Not every feature described in these Terms will be available at every Campground.
Campgrounds are independently owned and operated businesses. Unless expressly stated otherwise, campersAPP does not own, operate, manage, or control participating Campgrounds.
2. Eligibility and Family Use
campersAPP is a general-audience service and is not directed specifically to children under 13.
Children under 13 should not create an independent campersAPP account or submit personal information without the involvement and permission of a parent or legal guardian.
Parents and guardians are responsible for supervising a child’s use of campersAPP, including games, activities, Photo Challenges, Geo Adventures, and other interactive campground features.
3. Accounts, Access Codes, and Private Groups
Some campersAPP features may be available without an individual account. Other features may require an account, campground access code, QR code, invitation, or other authorization.
You agree to provide accurate information when creating or using an account and to keep your account credentials secure.
Some Campgrounds may provide access to private groups, events, information, activities, promotions, or other content intended only for specific guests, such as seasonal campers, rallies, wedding groups, staff, or other authorized participants.
You may not knowingly share private access codes, QR codes, account credentials, or restricted content with individuals who are not authorized to receive them.
You are responsible for activity conducted through your account or credentials unless otherwise required by applicable law. Please contact campersAPP promptly if you believe your account has been accessed without authorization.
4. Campground Dashboard Access and Confidentiality
campersAPP may provide participating Campgrounds with access to a non-public administrative dashboard, management portal, reporting tools, configuration tools, training materials, demonstrations, documentation, and other business resources (collectively, the “Campground Dashboard”).
Access to the Campground Dashboard is provided solely for the internal business use of the participating Campground. A Campground may provide access to its owners, managers, and employees who reasonably require access to administer that Campground’s campersAPP service.
The Campground is responsible for ensuring that individuals provided with access to its Campground Dashboard comply with these Terms and for promptly removing access when it is no longer required.
Login credentials and access rights may not be sold, transferred, shared, or made available to unauthorized persons.
The Campground Dashboard and other non-public campersAPP materials may contain confidential and proprietary information, including software interfaces, functionality, workflows, feature designs, administrative tools, product information, documentation, reports, demonstrations, development information, and other non-public aspects of campersAPP.
Participating Campgrounds and their authorized users may not provide access to, demonstrate, disclose, distribute, photograph, screen-record, reproduce, or otherwise make non-public portions of the Campground Dashboard or campersAPP services available to anyone outside their own organization without our prior written permission.
The Campground Dashboard and other non-public campersAPP materials may not be used for competitive intelligence, competitive benchmarking, copying or reproducing campersAPP functionality, reverse engineering, or assisting another person or company in developing, evaluating, or improving a competing product or service.
Access to the Campground Dashboard may be suspended or terminated when a Campground’s campersAPP service ends or when campersAPP reasonably believes access has been misused.
Upon termination of access, the Campground and its authorized users must cease accessing and using non-public campersAPP systems and materials.
The confidentiality and restricted-use obligations in this section survive termination of the Campground’s campersAPP service.
5. Campground Subscriptions and Cancellation
Participating Campgrounds subscribe to campersAPP on a recurring monthly basis at the subscription rate agreed upon when service is established, unless different terms are provided in a separate written agreement.
If you create, administer, or accept these Terms on behalf of a Campground or other business, you represent that you have authority to bind that organization to the applicable Terms.
Subscription fees are billed monthly and continue until the Campground cancels its service. A Campground may terminate its subscription by providing campersAPP with at least 30 days’ written notice of cancellation. Cancellation requests may be submitted to [email protected] or through another written method designated by campersAPP.
The Campground remains responsible for subscription fees and other amounts due through the effective date of cancellation. Unless otherwise required by law or agreed to in writing, amounts already paid are non-refundable and partial-month refunds or credits are not provided.
Upon termination, access to the Campground Dashboard and other subscriber-only services may be discontinued.
If a separate subscription, service, order form, or other written agreement between campersAPP and the Campground contains different billing or cancellation terms, that agreement will control.
6. Location-Based Features
Some campersAPP features use location information, including approximate, precise, or background location when you have granted the appropriate device permissions.
Location may support features such as campground arrival recognition, location-based games and Geo Adventures, maps, loyalty programs, campground notifications, and optional location-based offers.
You may control location permissions through campersAPP and your device settings. Certain features may not function properly if location access is disabled.
Use of location information is further described in our Privacy Policy.
Maps, Directions, and Location Accuracy
Maps, directions, location estimates, radar functions, nearby information, and other location-based content are provided for convenience and may not always be complete, current, or accurate.
Always follow posted signs, Campground rules, road restrictions, weather advisories, emergency instructions, and applicable laws.
Do not rely on campersAPP as your sole source of navigation, safety, or emergency information.
7. Geo Adventures, Games, and Physical Activities
campersAPP may offer Geo Adventures, scavenger hunts, location-based games, challenges, scorecards, QR-based activities, and other recreational experiences.
Participation may involve walking, hiking, driving, navigating campground property, visiting designated locations, scanning codes, or participating in physical activities.
You are responsible for exercising reasonable judgment and participating safely. You agree to:
- Follow Campground rules and posted signs
- Remain in authorized public or guest areas
- Avoid trespassing or entering restricted areas
- Be aware of terrain, vehicles, weather, wildlife, water, and other hazards
- Supervise children appropriately
- Stop participating if conditions appear unsafe
campersAPP does not guarantee that a location, cache, QR code, activity area, trail, or other destination is accessible or safe at any particular time.
8. Loyalty Programs, Punch Cards, Rewards, and Offers
Campgrounds may offer loyalty programs, digital punch cards, rewards, coupons, promotions, contests, or other incentives through campersAPP.
Unless otherwise stated, rewards and digital punches have no cash value, are not transferable, and may be subject to Campground-specific eligibility, redemption, expiration, availability, or other rules.
Loyalty punches, points, rewards, and redemptions are specific to the Campground that issued them and may not be earned at one participating Campground and redeemed at another.
Campgrounds may establish reasonable measures designed to prevent duplicate, unauthorized, or fraudulent punches and redemptions.
Attempting to manipulate QR codes, location verification, cooldown periods, redemption codes, or other reward mechanisms may result in cancellation of a reward or suspension of access to the applicable feature.
Certain promotions, contests, or rewards may have additional terms or official rules. Those additional rules will apply to your participation.
9. Promotions, Advertising, and Sponsored Content
campersAPP may display promotions, offers, coupons, advertisements, or sponsored content from participating Campgrounds or third-party businesses.
Some offers may be displayed based on location when you have enabled applicable location-based features.
Sponsored placement does not constitute an endorsement or guarantee by campersAPP of the advertiser, sponsor, product, service, price, availability, or offer.
Third-party businesses are responsible for their own goods, services, offers, representations, and fulfillment.
If you choose to redeem an offer, make a purchase, or otherwise transact with a third-party business, additional terms or policies of that business may apply.
10. Purchases and Payments
Some Campgrounds allow guests to purchase goods or services through campersAPP, including items such as food, firewood, ice, rentals, merchandise, or other campground services.
Prices, taxes, inventory, fulfillment, refund policies, and availability are established by the participating Campground.
Stripe Payments
Payments made through the campersAPP payment system may be processed by Stripe, an independent third-party payment processor.
When you enter card information, your full card number and sensitive payment credentials are handled by Stripe. campersAPP and the participating Campground do not receive or store your full payment card number through campersAPP.
campersAPP may retain a secure payment token, transaction reference, and limited transaction information as necessary to facilitate purchases, receipts, refunds, transaction history, or customer support.
Stripe’s services are subject to Stripe’s own terms and privacy practices.
Campground Payment Systems
Some Campgrounds may process payments through their own point-of-sale or other payment systems. Those transactions may be subject to the Campground’s or payment provider’s own terms, policies, and refund practices.
Unless otherwise stated, the participating Campground is responsible for fulfillment of the goods or services purchased from that Campground.
11. Check-In Forms, Waivers, and Electronic Signatures
Campgrounds may use campersAPP to provide check-in forms, waivers, acknowledgments, registrations, agreements, or other guest documents.
When you electronically sign, acknowledge, or submit a document through campersAPP, you agree that your electronic action may have the same effect as a handwritten signature or acknowledgment where permitted by law.
You are responsible for reviewing a document before signing or submitting it.
campersAPP provides the technology used to create, deliver, and store these documents on behalf of participating Campgrounds. Unless expressly stated otherwise, the applicable agreement or waiver is between you and the participating Campground, not campersAPP.
Completed documents may be retained by the Campground in accordance with its operational, legal, insurance, safety, or recordkeeping requirements.
12. Photo Challenges and User Content
campersAPP may allow you to submit photographs, text, comments, contest entries, forms, suggestions, or other content (“User Content”).
By submitting User Content through campersAPP, you grant campersAPP and the participating Campground a non-exclusive, royalty-free license to host, store, reproduce, transmit, and display that content as reasonably necessary to operate the feature through which it was submitted.
Photo Challenges and Promotional Use
Certain Photo Challenges or similar features may include a notice stating that submitted photographs may be used by the participating Campground for marketing or promotional purposes.
When that notice is presented, participating in the Photo Challenge and submitting a photograph constitutes your agreement to the content-use permission described in that notice.
Where promotional use is disclosed, you grant the participating Campground, and campersAPP where necessary to facilitate that use, a non-exclusive, royalty-free license to reproduce, display, publish, and use the submitted content for the marketing or promotional purposes described in the notice.
You represent that you have the right to submit the content you provide. If your content includes another identifiable person, you are responsible for obtaining any permission reasonably necessary for the submission and permitted use of that content.
You may not submit content that:
- Violates another person’s intellectual property, privacy, publicity, or other rights
- Is unlawful, fraudulent, threatening, harassing, hateful, or abusive
- Contains malicious code or attempts to interfere with campersAPP
- Is intentionally false or misleading
- Promotes illegal activity
- Contains unauthorized commercial solicitation or spam
campersAPP may remove content or restrict access when reasonably necessary to enforce these Terms, protect users or Campgrounds, comply with law, or protect the Service.
13. Suggestions, Surveys, and Guest Submissions
campersAPP may allow guests to submit suggestions, surveys, polls, feedback, bug reports, contest entries, or other information.
You understand that submissions intended for a Campground may be provided to authorized Campground staff.
If you provide campersAPP with suggestions, ideas, recommendations, feature requests, or other feedback, you grant campersAPP the unrestricted right to use, modify, incorporate, develop, and commercialize that feedback without restriction, compensation, or obligation to you.
14. Push Notifications and Communications
If you enable notifications, campersAPP may deliver activity reminders, Campground announcements, safety or operational information, loyalty information, private group messages, promotions, or other notifications associated with your campground experience.
Some notifications may depend on whether you are located at or near the Campground.
You can manage notification preferences through campersAPP where controls are available or through your device settings.
Delivery of a notification is not guaranteed. Messages may be delayed or prevented by device settings, connectivity, operating-system restrictions, or other circumstances outside campersAPP’s control.
Emergency Information
campersAPP is not an emergency communications service.
Do not rely on campersAPP notifications, alerts, maps, or Safety Center information as a substitute for calling 911 or another appropriate emergency service or following instructions from Campground staff or public authorities.
15. Interactions With Other Guests
Some features may facilitate activities, groups, games, meet-ups, contests, or other interactions involving Campground guests.
You are responsible for your own interactions and decisions regarding participation with other individuals.
campersAPP does not control the conduct of Campground guests and is not responsible for acts or omissions of other users.
16. Campground Content and Services
Participating Campgrounds are responsible for the information, policies, schedules, prices, activities, rules, promotions, services, and other content they publish or make available through campersAPP.
campersAPP provides the platform but does not guarantee the accuracy, availability, completeness, or timeliness of Campground-provided content.
Activity schedules, hours, amenities, prices, promotions, availability, rules, and other Campground information may change without notice.
Campgrounds retain ownership of the names, logos, trademarks, photographs, text, and other content they provide to campersAPP. By providing that content, the Campground grants campersAPP a non-exclusive license to host, reproduce, display, format, and use it as reasonably necessary to provide and promote the Campground’s campersAPP service. The Campground represents that it has the rights necessary to provide that content for such use.
17. Third-Party Services and Links
campersAPP may provide links or access to reservation systems, maps, payment services, restaurants, attractions, merchants, websites, or other third-party services.
Third-party services are independently operated and may be governed by their own terms and privacy practices.
campersAPP does not control and is not responsible for third-party websites, products, services, content, or transactions.
18. Acceptable Use
You agree not to:
- Use campersAPP for unlawful, fraudulent, abusive, or deceptive purposes
- Attempt to gain unauthorized access to accounts, private groups, systems, or data
- Interfere with or disrupt the Service
- Circumvent security, location verification, reward, or redemption controls
- Reverse engineer, copy, scrape, extract, or commercially exploit campersAPP except as permitted by law
- Introduce viruses, malicious code, automated attacks, or other harmful technology
- Impersonate another person or misrepresent your identity or authorization
- Violate the rights of campersAPP, a Campground, another user, or a third party
- Use campersAPP, the Campground Dashboard, or any non-public campersAPP information to train, benchmark, evaluate, design, develop, or improve a competing product, service, software platform, artificial intelligence system, or machine-learning model.
- Permit any competitor or prospective competitor of campersAPP to access the Campground Dashboard, whether directly through login credentials or indirectly through demonstrations, screen sharing, screenshots, recordings, exports, or other reproductions of non-public portions of the Service.
- Share, demonstrate, record, disclose, reproduce, or use non-public campersAPP systems or materials in violation of the Campground Dashboard confidentiality requirements in these Terms
We may suspend or terminate access when we reasonably believe these Terms have been violated or when necessary to protect campersAPP, participating Campgrounds, users, or others.
19. campersAPP Intellectual Property
campersAPP and the Service are licensed, not sold, to you.
campersAPP and its software, designs, graphics, trademarks, logos, interfaces, features, databases, technology, and other proprietary materials are owned by or licensed to Gere Enterprises LLC and are protected by applicable intellectual property laws.
These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable right to use campersAPP for its intended purposes.
You may not copy, modify, distribute, sell, license, create derivative works from, reverse engineer, or commercially exploit campersAPP or its proprietary materials except as expressly authorized by us or permitted by law.
Nothing in these Terms transfers ownership of campersAPP intellectual property to you.
20. Privacy
Our collection and use of personal information is described in the campersAPP Privacy Policy, available at:
https://app.campersapp.com/privacy
The Privacy Policy is incorporated into these Terms by reference.
21. Service Availability and Changes
campersAPP continues to evolve. Features may be added, changed, limited, suspended, or discontinued.
We do not guarantee that every feature will always be available at every Campground or on every device.
We may update campersAPP or these Terms when reasonably necessary for security, functionality, legal compliance, product development, or other operational reasons.
When these Terms are materially updated, we will revise the “Last Updated” date and may provide additional notice where appropriate.
22. Suspension and Termination
You may stop using campersAPP at any time.
You may request deletion of an eligible campersAPP account through the account-deletion functionality provided in campersAPP or by contacting [email protected].
campersAPP may suspend or terminate access to the Service when reasonably necessary because of misuse, fraud, security concerns, violation of these Terms, legal requirements, or discontinuation of the Service.
Termination does not automatically require a participating Campground to delete records it independently maintains or is legally entitled or required to retain, including waivers, transaction records, or other Campground records.
23. Disclaimer of Warranties
To the fullest extent permitted by applicable law, campersAPP is provided on an “as is” and “as available” basis.
campersAPP does not guarantee that the Service will always be available, uninterrupted, error-free, secure, accurate, or compatible with every device.
To the fullest extent permitted by law, campersAPP disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and any other warranties that may otherwise arise by law.
Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
24. Limitation of Liability
To the fullest extent permitted by applicable law, Gere Enterprises LLC, campersAPP, and their owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of campersAPP.
This includes, without limitation, damages arising from:
- Service interruptions or technical failures
- Inaccurate Campground or third-party information
- Lost or delayed notifications
- Location or mapping inaccuracies
- Third-party products, services, advertisements, or offers
- Acts or omissions of participating Campgrounds, businesses, or other users
- Loss of data except where liability cannot legally be excluded
To the fullest extent permitted by applicable law, campersAPP’s total liability for claims arising from your use of the Service will not exceed the greater of $100 or the amount you paid directly to campersAPP for use of the Service during the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
25. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Gere Enterprises LLC, campersAPP, and their owners, officers, employees, contractors, and agents from claims, damages, liabilities, costs, and expenses arising from your unlawful use of the Service, your violation of these Terms, your infringement of another person’s rights, or User Content you submit.
A participating Campground agrees, to the extent permitted by law, to indemnify and hold campersAPP harmless from third-party claims arising from content supplied by the Campground, products or services offered by the Campground, Campground-created promotions or advertisements, Campground activities, waivers or agreements created by the Campground, or the Campground’s violation of applicable law or another person’s rights.
26. Equitable Relief
You acknowledge that unauthorized access to, disclosure of, copying of, or use of campersAPP’s confidential information, proprietary technology, intellectual property, or non-public systems may cause harm that cannot be adequately remedied by monetary damages alone.
To the extent permitted by law, campersAPP may seek injunctive relief, specific performance, or other equitable remedies to prevent or stop an actual or threatened violation of these Terms, in addition to any other remedies available at law or in equity.
27. Governing Law and Disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
Before filing a legal action relating to these Terms, you and campersAPP agree to make a reasonable effort to resolve the dispute informally by contacting the other party and providing a description of the issue.
Unless applicable law requires otherwise, legal proceedings relating to these Terms may be brought in the state or federal courts having jurisdiction in Arizona.
Nothing in this section limits any consumer right or remedy that cannot legally be waived.
28. Miscellaneous
If any provision of these Terms is determined to be unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
You may not transfer your rights under these Terms without our permission. campersAPP may transfer its rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, or similar business transaction.
These Terms, our Privacy Policy, and any additional terms presented for a particular feature constitute the agreement governing your use of campersAPP. Campground-specific agreements, waivers, promotion rules, or other terms may also apply to particular transactions or activities.
Any provisions that by their nature should survive termination or expiration of these Terms will survive, including provisions concerning confidentiality, intellectual property, payment obligations, User Content licenses, indemnification, limitations of liability, equitable relief, and dispute resolution.
